Mozy Expedition Participant Agreement & Liability Waiver

1. Acknowledgment of Risk

Participant understands that outdoor water activities involve inherent risks, including but not limited to:

• slips, trips, falls, and uneven terrain
• oyster beds, shells, rocks, roots, driftwood, mud, and submerged hazards
• watercraft loading, unloading, launching, docking, and operation
• changing tides, currents, wakes, wind, weather, and water conditions
• exposure to sun, heat, insects, wildlife, and natural environments
• cuts, scrapes, punctures, or injury from shells, fossils, shark teeth, or natural objects
• physical exertion while walking, wading, boarding, disembarking, or exploring shoreline areas
• collision, capsizing, equipment failure, accidental immersion in water, or other water-related incidents

Participant understands that these risks may result in property damage, injury, illness, or death. Participant voluntarily accepts and assumes all risks associated with participation in the Expedition.

2. Participant Responsibility

Participant agrees to: follow all instructions provided by Mozy staff, guides, or representatives; act responsibly around watercraft, docks, ramps, shorelines, and water access areas; wear secure footwear appropriate for shoreline and island terrain; avoid unsafe behavior, horseplay, or conduct that could endanger themselves or others; immediately report unsafe conditions, injuries, or concerns; and remain within designated exploration or operating areas unless instructed otherwise. Participant understands that Mozy may delay, modify, shorten, cancel, or end the Expedition due to weather, tides, safety concerns, equipment issues, participant conduct, or other conditions.

3. Physical Condition and Medical Responsibility

Participant confirms that they are physically capable of participating in the Expedition and do not have any medical condition that would make participation unsafe. Participant understands that remote shoreline and island areas may not have immediate medical access or emergency services nearby. Participant assumes full responsibility for their own medical needs, medications, hydration, sun protection, mobility limitations, and personal health conditions.

4. Footwear Requirement

Participant understands that shoreline and island terrain may contain sharp shells, oyster beds, rocks, submerged debris, uneven surfaces, mud, slippery areas, and other hazards. Participant agrees to wear secure footwear during the Expedition. Barefoot participation during shoreline or island exploration is strongly discouraged and may be prohibited by Mozy staff or guides.

5. Safety Equipment and PFDs

Participant understands that personal flotation devices (“PFDs”) may be provided or required during portions of the Expedition. Participant agrees to follow all Mozy instructions regarding PFDs, emergency lanyards, watercraft safety, boarding, disembarking, and other safety equipment.

6. Guided Activity

Participant understands that the Expedition is a guided outdoor recreational activity and not a common-carrier transportation service. Mozy may make route, timing, landing, or activity decisions based on weather, tides, water conditions, safety, and guide judgment.

7. Release of Liability

To the fullest extent permitted by law, Participant releases and discharges Mozy Ventures LLC d/b/a Mozy Outdoors, its owners, employees, guides, contractors, affiliates, partners, agents, and representatives from any and all claims, liabilities, demands, damages, losses, or causes of action arising from or related to participation in the Expedition, including claims arising from ordinary negligence. This release includes claims relating to: personal injury, illness, death, property damage, water-related incidents, transportation to/from island or shoreline areas, natural terrain hazards, equipment use, guide instructions or decisions, weather, tides, currents, wakes, or changing environmental conditions. Participant understands that this Agreement is intended to be broad and inclusive to the maximum extent allowed by applicable law.

8. Indemnification

Participant agrees to indemnify and hold harmless Mozy Ventures LLC d/b/a Mozy Outdoors and its owners, employees, guides, contractors, affiliates, partners, agents, and representatives from any claims, damages, losses, liabilities, costs, or expenses arising from Participant’s conduct, actions, failure to follow instructions, or violation of this Agreement during the Expedition.

10. Minors

Participants under 18 must have this Agreement completed by a parent or legal guardian. The parent or guardian acknowledges the risks associated with participation and grants permission for the minor to participate in the Expedition. Guardian information fields appear below when “Under 18” is selected.

11. Acknowledgment

By signing below, Participant acknowledges that: they have read and understood this Agreement; they understand the risks involved in guided outdoor water activities; they are voluntarily participating; they understand this is a release of liability and assumption of risk agreement; and they agree to follow guide instructions and safety requirements during the Expedition.

12. Governing Law and Venue

This Agreement shall be governed by and interpreted under the laws of the State of North Carolina. Any legal action relating to this Agreement shall be brought in New Hanover County, North Carolina, unless otherwise required by law.
